Grandfather Request Form

How to "Grandfather"

Grandfathering is the process of establishing that an existing zoning nonconformity was established legally and that the use has been "continuously occupied" since it was established. The research is conducted by the Department of Community Development staff, however, the burden of proof to establish that a nonconformity is legally existing rests with the property owner.

The Department of Community Development only conducts this research when an interested party requests it. To request a property be "grandfathered" please fill out a Grandfather Request Form and submit the required materials, including a $40.00 fee to the Department of Community Development at:
